Mike Blazick Obtains Defense Verdict in Claim Involving Pedestrian Hit by Car

Mike Blazick recently obtained a defense verdict in a claim involving a pedestrian that was hit by a car while crossing a highway. The plaintiff argued that the defendant negligently operated her car by failing to observe the pedestrian crossing the roadway. The Plaintiff was life-flighted to a trauma center and sustained multiple injuries including a fractured left distal radius. Mike was successful in rebutting the Plaintiff’s allegations and proved that the Plaintiff was primarily responsible for the accident resulting in a jury verdict in favor of his client.

Mike Blazick Obtains Summary Judgment on Bad Faith Claim Arising out of First-Party Income and Wage Loss Claim and Affirmance in the Third Circuit Court of Appeals

Mike Blazick obtained summary judgment on behalf of Hartford Underwriters Insurance Company in a bad faith claim arising out of the handling of its insured’s claim for income loss and medical benefits under a Delaware automobile insurance policy. Plaintiff filed suit in the Philadelphia Court of Common Pleas and Mike promptly removed the case to the United States District Court for the Eastern District of Pennsylvania. At the close of discovery, Mike moved for summary judgment arguing that the insured not only failed to establish Hartford acted in bad faith, but also failed to establish that Hartford improperly denied income and wage loss benefits. The Federal District Court agreed and entered summary judgment in favor of Hartford. The Plaintiff appealed to the Third Circuit Court of Appeals arguing that the District Court failed to consider her expert reports. Mike argued that the expert evidence not only failed to support the insured’s claims, but that the evidence supported the District Court’s dismissal of the insured’s suit. The Third Circuit agreed and affirmed summary judgment in favor of Hartford.

Mark Fontanella obtains Dismissal of a Class Action Suit

Mark Fontanella obtained dismissal of a filed class action lawsuit against an insurance carrier for improperly reducing all policy holders’ underinsured motorist benefits. The claimant maintained that she was entitled to $2 million in coverage and pursued a declaratory judgment action and class certification. After removing the litigation to the United States District Court in Harrisburg, the Court ruled in Mark’s client’s favor, dismissing all of the claimant’s claims.

Mike Blazick Represents Manufacturer in Tragic Wrongful Death Claim

Mike recently represented a major farming equipment manufacturer in a claim involving the tragic death of a thirty-two year old woman. The Plaintiff was killed when the farming implement manufactured by Mike’s client broke apart on a public roadway and crashed into the decedent’s vehicle. The case was in litigation for over two years, involved experts in the fields of metallurgy, mechanical engineering, forensic pathology, and accident reconstruction. The case resulted in a settlement after summary judgment and Frey motions were filed.

Mike Blazick Appointed Special Counsel to the Luzerne County Court of Common Pleas

Mike Blazick was recently appointed special counsel by the President Judge of the Luzerne County Court of Common Pleas. Mike was appointed to assist the Court review a case to determine whether judicial corruption influenced the outcome of the case as ordered by the Pennsylvania Supreme Court.

Mark Fontanella Obtains Non-Suit of Bad Faith and Extra-Contractual Claims

Mark Fontanella obtained a non-suit of an insurance bad faith and other extra-contractual claims in Philadelphia County. The claimant brought suit based upon alleged water and mold damage to their home and sought damages in excess of $500,000. Following the granting of a non-suit on the bad faith claims, the parties settled the remaining contract and damage claims for less than $5,000.

Mike Blazick Wins Endorsement of Local Media Outlets for Judge of Luzerne County Court of Common Pleas

In the May 2009 primary election for Judge of the Luzerne County Court of Common Pleas, Mike Blazick was one of two candidates in a seventeen candidate field to win endorsements from both Luzerne County newspapers being referred to as “the whiz kid” and a breath of fresh air on the judicial landscape.
